My top card in SLI gets to near 100 C I am running 2 ASUS GTX 770 cards is this safe for the card or should I take one card out or run the second card in the 3rd x16 slot

That is way too hot.    What mobo and case do you have?   I thought Virtue case but not sure.

Problem is the Gryphon mobo's bottom Pciex16 slot isn't meant for video card. Its a x16 slot but only electrically wired x4 and not to the cpu.       

The Asus cards dump heat into the case. The Virtue has a single 140mm fan in front. I would wait for the heat to build and pull side cover. If its hot then you might have to get two Corsair 140mm AF fans for the front panel.    It might help.

Make sure both cards fans are working.    Swap their position to make sure its not a bad card.   If its hot inside and both cards in top slot get to 100C then you have an airflow problem.     The reference cards with single fan that exit heat out the back might be the fix.    But try the front fans first.

The way nVidia set up the new GTX7xx series is that they are speed controlled by temp and the default max temp is 80 ºC. Are they being OC'd? I'd look at the Boost 2.0 settings and make sure the max temp is set (in the 80 ºC range should be fine). Also, you should add the second fan (and any others that you can) to optimize airflow and make sure the fans are running properly as well...
